بيان حزب العدل بشأن إقرار الكنيست الإسرائيلي قانون إعدام الأسرى الفلسطينيين

يرفض حزب العدل ويدين بأقسى العبارات إقرار الكنيست الإسرائيلي لقانون يجيز إعدام الأسرى الفلسطينيين، ويعتبره انحدارًا خطيرًا وغير مسبوق نحو شرعنة القتل خارج إطار القانون، وتكريسًا رسميًا لسياسات الإبادة والعقاب الجماعي التي تمارسها سلطات الاحتلال بحق الشعب الفلسطيني.

إن هذا القانون – الذي هو امتداد للسلسلة من السياسات التصعيدية والجرائم الممنهجة التي تنتهجها حكومة بنيامين نتنياهو واليمين المتطرف – يمثل جريمة حرب صريحة ومكتملة الأركان، وانتهاكًا فجًا لكافة قواعد القانون الدولي الإنساني، وعلى رأسها اتفاقيات جنيف، التي تلزم سلطات الاحتلال بحماية الأسرى وضمان حقوقهم، لا تصفيتهم جسديًا تحت غطاء تشريعي باطل يفتقر إلى أي شرعية قانونية أو أخلاقية.

ويؤكد الحزب أن ما جرى ليس مجرد تشريع داخلي، بل إعلان صريح عن نية ممنهجة لتصفية الأسرى و استخفافًا صارخًا بالقانون الدولي، وتحديًا وقحًا لإرادة المجتمع الدولي، واستهانة كاملة بقيم العدالة وحقوق الإنسان.

ويطالب الحزب بتحرك دولي عاجل وملموس، يتجاوز البيانات الدبلوماسية إلى إجراءات حقيقية، تشمل:
• ضم المحكمة الجنائية الدولية هذا التشريع كدليل إضافي على نية الإبادة والاضطهاد العرقي في ملفاتها المفتوحة ضد قادة الاحتلال
• فرض عقوبات رادعة على سلطات الاحتلال،
• وتوفير حماية دولية فورية للأسرى الفلسطينيين.

كما يدعو إلى موقف عربي أكثر حسمًا ووضوحًا، يرتقي إلى مستوى الخطر، ويعبر عن إرادة سياسية حقيقية في مواجهة هذه الانتهاكات، بدلًا من الاكتفاء بمواقف تقليدية لم تعد تواكب حجم الجريمة.

ويشدد حزب العدل على أن أي محاولة لشرعنة القتل لن تمنح هذه الممارسات صفة قانونية، بل ستزيد من عزل مرتكبيها، وتؤكد أن استمرار هذه السياسات لن يؤدي إلا إلى مزيد من التصعيد وعدم الاستقرار في المنطقة.

ويجدد الحزب موقفه الثابت بأن حقوق الشعب الفلسطيني غير قابلة للتصرف، وعلى رأسها الحق في الحياة والحرية والاستقلال، وإقامة دولته المستقلة، وأن هذه الحقوق لن تسقط بالتشريعات الجائرة أو بمرور الزمن.

Statement on the Israeli Knesset’s Passage of the Prisoner Execution Law

ElAdl Party categorically rejects and condemns, in the strongest possible terms, the Israeli Knesset’s passage of a law authorizing the execution of Palestinian prisoners. The Party views this move as a dangerous and unprecedented descent toward the institutionalization of extrajudicial killings and a formal entrenchment of policies of genocide and collective punishment practiced by the occupation authorities against the Palestinian people.

This legislation – an extension of the escalatory policies and systemic crimes pursued by the government of Benjamin Netanyahu and the far-right – constitutes a full-fledged war crime. It is a flagrant violation of the fundamental tenets of International Humanitarian Law, foremost among them the Geneva Conventions, which mandate that an occupying power protect prisoners and guarantee their rights, rather than physically liquidating them under a void legislative cover that lacks all legal and moral legitimacy.

The Party underscores that this is not merely internal legislation, but an overt declaration of a systematic intent to liquidate prisoners. It represents a blatant disregard for international law, a defiant challenge to the will of the international community, and a total contempt for the values of justice and human rights.

ElAdl Party calls for urgent and tangible international intervention that transcends diplomatic rhetoric, demanding concrete measures, including:

• The International Criminal Court (ICC) must incorporate this legislation into its active case files against occupation leaders as further evidence of genocidal intent and ethnic persecution.
• The imposition of deterrent sanctions on the occupation authorities.
• The provision of immediate international protection for Palestinian prisoners.

Furthermore, the Party calls for a more decisive and unified Arab position – one that rises to the magnitude of this threat and reflects a genuine political will to confront these violations, moving beyond traditional stances that no longer suffice given the gravity of the crime.

ElAdl Party emphasizes that any attempt to “legalize” killing will never grant these practices legal standing; rather, it will further isolate the perpetrators. The continuation of such policies will only serve to fuel further escalation and regional instability.

The Party reaffirms its steadfast position that the rights of the Palestinian people are inalienable – chief among them the rights to life, liberty, and independence. The establishment of an independent state is a right that shall not be diminished by unjust legislation or the passage of time.
